HB 1471 CS - Energy Diversity and Efficiency
GENERAL BILL   by Attkisson; RECOMMENDED by Utilities & Telecommunications Committee
Energy Diversity and Efficiency: Creates the "Florida Energy Diversity and Efficiency Act"; provides requirements for the authorization, certification, and siting of nuclear power plants; provides for a Nuclear Power Plant Siting Board; enumerates the related powers and duties of the Department of Environmental Protection, including rulemaking authority; requires certain application, certification, and licensure of nuclear power plants; specifies applicability to certain nuclear power plants; provides for distribution of certain applications and schedules; directs the Division of Administrative Hearings to appoint an administrative judge to conduct certain hearings; provides for the determination of application and amendment completeness; requires a review of land use and zoning consistency; requires affected agencies to submit certain reports; requires public notice of department recommendation and petition for certification hearings; provides for land use and certification hearings; authorizes the board to have final disposition on certification applications; provides that this act supersedes certain laws and regulations; provides for effect of certification; requires certain public notice; provides responsibility for certain costs; provides for revocation or suspension of certification; provides for appeal and review of proceedings under the act; provides for compliance enforcement; requires the department to make certain information relating to power plant siting available to the public; provides requirements and procedures for modification of certification; provides for supplemental applications for sites certified for ultimate site capacity; requires certain fees; provides for deposit into the Florida Permit Fee Trust Fund and subsequent distribution; requires the Public Service Commission to hold hearings on determination of need; requires the Public Service Commission to implement rules related to nuclear power plant cost recovery; requires a report.
